Samsung uses a movie sequence as an evidence in patent infringement legal battle against Apple

Samsung’s lawyers are becoming increasingly creative as the legal process Apple started against South Korean user electronics manufacturer continues. Now they want to proof that Apple’s ipad design isn’t as original as widely promoted. Apparently there is an scene in a famous science fiction classic 2001: A Space Odyssey where a device similar to what we know today as a tablet is clearly visible. Amazingly this movie was made all the way back in 1968. You can see this scene in the Youtube video bellow.

Apple scores against Samsung

Galaxy tab 10.1

Apple’s legal actions have gained a big success at least temporarily and now Samsung cant sell their Galaxy Tab 10.1 in almost entire European Union with exception of Netherlands where the court process is still not over. To remind you, the action taken by Apple is based on the external design of the device, not on hardware running it. Apple claims that Samsung has stolen the appearance of Apple’s unique products in order to profit on Apple’s successful image. As a consequence, Samsung must block it’s tablet sales and stop all related advertisings, only 10 days after it’s latest tablet Galaxy Tab 10.1 appeared on the European market. Steve Jobs and his team have earlier filled complaints to ITC (International Trade Commission) and they have also sued Samsung on various patent infringements. All this was followed with a strong PR campaign against Samsung where they have strongly criticized Samsung and called them copyist.

Apple goes against Samsung, complaints sent to ITC

Apple has recently succeed in getting attention from International Trade Commission with their patent infringement law suit versus South Korean consumer electronics manufacturer Samsung. International Trade Commission can easily deny importation of consumer products which were judged to be connected with patent rights violations. But despite being capable of stopping imports of disputable products, ITC in the past didn’t act too often on this ground. Usually the threat of sanctions alone was sufficient to pressure companies into negotiations and this was in many cases followed by million s of dollars in patent fees payments.

Apple number one Smartphone producer in US, Android best smartphone OS

An recently published study of the American smartphone market by Nielsen Media, Apple is the best manufacturer in US but Android made by Google is the top smartphone OS way ahead of iOS.

The research claims that Apple commands 28 percent of the US market and the second manufacturer behind Apple is Taiwanese HTC which has control of 14 percent’s with their Android powered devices and 6 percent with their Windows Phone 7 powered smartphones. Motorola and Samsung are behind with 11 and 8 percent’s respectively.

iPhone5 and the iPad3 may make their first appearance behind closed doors

Now everyone knew that the lawsuit between Apple and Samsung would produce some big explosions and demanding to see Apple’s new treats is probably one of them. Just this Friday Samsung filed a monition which asks Apple to willingly turn over their new iPad 3 and iPhone 5 as their discovery process.

Apple vs Samsung: stop copying our devices!

The battle of smartphones continue. One of the essential parts of the battle seems to be legal as companies in this market try to sue one another out of the market. The recent lawsuit that Apple wagged against Samsung is only the top of the iceberg. Apple has also recently sued Microsoft over the App Store name infringement. Also Amazon, HTC, Nokia are being sued. This time Apple claims that Samsung infringed their intellectual property rights, patents and trademarks including the look, user interface, packaging and other details. Apple says that Samsung has blatantly copied design of its devices iPhone and iPad with their Samsung Galaxy series of smartphones and tablets. Even the design of the icons is extremely similar and Apple is proving this with pictures of the Galaxy tablet home screen. Apple claims that this is pure copying of their products.
