iPhone5 and the iPad3 may make their first appearance behind closed doors
Now everyone knew that the lawsuit between Apple and Samsung would produce some big explosions and demanding to see Apple’s new treats is probably one of them. Just this Friday Samsung filed a monition which asks Apple to willingly turn over their new iPad 3 and iPhone 5 as their discovery process.
The kicker! Is that Samsung has claimed that its future products such as the Galaxy Tab 10.1 and the Droid Charge will hit the market at the same time that Apple’s new goodies do and so they want to make sure that they aren’t any similarities between the two company’s products. Well even though this may sound crazy it is still legal and it comes just days after the judge in the case ordered Samsung to hand over their pre-production samples of the much awaited Droid charge, Galaxy X II, Infuse 4G as well as the Galaxy Tab 10.1in order for apple to determine if the products we be part and parcel of the case which should lead them to file a motion to block these products from the market if the company found similarities.
They big difference between the requests by both Samsung and Apple is the fact that Samsung has already make its products public while Apple is still keep silent about its future releases. This means that if Apple brings its products in front of Samsung’s legal team the word will be out that Apple has been working on release both the iPad3 and the iPhone5. This will essentially break Apple’s traditional iron clad silence about its future releases.
The question that everyone is asking is what if Samsung does find similarities between the iPhone 5 and its Droid Charge which infringes Apple’s trademarks? Are they going to go ahead and change everything that infringes? The outcome of such a battle is still unknown but it begs the question as to why Samsung is taking such a big risk. It could possibly be to get some leverage over Apple and it could be a pursuit which sees its products locked out if not delayed for a few more months.
From a user’s perspective however this could mean that the wait between the launches of Samsung’s and Apple’s products are delayed. But let’s not forget Samsung has already given away a few thousand pieces of its Droid Charge and many people already know what to expect from its other offerings so these guys do not have much to lose.
